Terms & Conditions

These Terms are provided to you prior to the conclusion of the purchase contract so as to guarantee unrestricted access to the text of the Terms. Please read the Terms and Conditions before opening an account in the Ms. Me e-shop or before purchasing goods without registration.

1. General provisions

1. The terms and conditions regulate the rules for placing orders and selling goods in the Ms. Me online store.

2. By placing an order, the customer confirms acceptance of the Terms and Conditions of the Ms. Me Fashion store and fully accepts them.

3. By placing an order for goods on special offer, the customer accepts the Terms and Conditions applicable to the goods on offer.

4. Ms. Me sells exclusively via the Internet.

5. The purchase contract concluded for the sale of goods is made in accordance with Swiss legislation and in the English language.

2. Presentation of goods

1. The Ms. Me store has made every effort to ensure that the published data is free of errors or inaccurate information.

2. If the description does not correspond to the photo or if the goods are defective, the customer is obliged to immediately inform the operator of the Ms. Me Fashion store.

3. All prices mentioned in the offer include VAT.

4. The price indicated for each item is valid at the time of placing the order. The store reserves the right to change the price of the goods in the offer, to add new products to the offer in the e-shop and to report, withdraw or change the promotional offers on the store website.

5. The products shown in the photos may differ slightly in colour from the actual condition.

6. All textual information and photographs of individual goods available on the Ms. Me Fashion  website are protected by copyright. It is forbidden to copy and distribute them, use them for commercial purposes and for presentation on other websites without our consent.

7. All trademarks and trade names are used for presentation purposes only and are the property of the manufacturers.

3. Customer registration

1. Registration is free and is done by filling out the registration form on the store’s website. 

2. When registering, it is necessary to provide correct and true information, otherwise the order cannot be completed. The customer must also comply with the same conditions for purchases without registration.

3. The personal data of customers are collected exclusively for the needs of the store and processed for the economic activity of the company, the conduct of promotional and advertising events and in accordance with the data protection requirements of the Law of Switzerland.

4. The ordering process

1. Orders are accepted only electronically on the website www.msmefashion.com – 7 days a week, 24 hours a day. 

2. Orders are processed on working days between 09:00 and 17:00.

3. After placing an order, each customer will receive, to the entered email address, information about the registration of the order together with its number.

4. Placing an order is identical to signing a business contract with Ms. Me. Fashion 

5. The customer can make changes to the order or cancel it until the tax document is issued. In case of changing or canceling the order, it is necessary to do so in your Ms. Me account or contact the customer service.

5. Order Processing

1. The store is obliged to deliver the goods in undamaged condition.

2. The order will be processed provided that the goods are available in stock or at the store’s suppliers. If the ordered goods are not available, the customer is informed about the status of the order and can decide how to proceed (partial processing of the order, extension of the waiting time, cancellation of the entire order).

3. Orders are processed as soon as they are placed until stocks last.

4. The Ms. Me store reserves the right to reject an order in the event of an error on the store’s website consisting of incorrect information about prices or the condition of the goods, as well as in cases where the authenticity of the data provided by the customer is suspected in when registering or placing an order.

5. By placing an order, the customer agrees to the use and processing of personal data by Swiss Post for the purpose of delivering the shipment.

6. Return of ordered goods

1. The customer can withdraw from the contract without giving any reason within 14 days from the date of delivery of the goods. The withdrawal period is considered maintained if the withdrawal notice was sent to the seller before the expiry of this period.

2. The customer can withdraw from the electronic communication contract and the provision of other electronic services within 14 days from the date of delivery of the goods, without giving any reason. The withdrawal period is considered maintained if the withdrawal notice was sent to the seller before the expiry of this period.

3. Consequences of withdrawal:

(a) in the case of a contract for the provision of a service, if the service has begun to be provided with the express consent of the Buyer and the Buyer has declared that he has been properly instructed that, by giving his consent, he loses the right to withdraw from the contract after full provision of the service; and if the service has been fully provided,

(b) in the case of a contract for the sale of goods or the provision of services the price of which depends on price movements in the financial market beyond the control of the Seller and which may occur during the withdrawal period;

(c) in the case of a contract that has as its object the sale of goods included in protective packaging that it is not appropriate to return for reasons of health or hygiene and whose packaging has been damaged after delivery,

(d) in the case of a contract whose object is the sale of goods which, by their nature, can be inseparably mixed with other goods after delivery,

(e) in the case of a contract for the execution of urgent repairs or maintenance requested by the Buyer specifically to the Seller.

4. The buyer has the right to withdraw from the contract within 14 days, without giving any reason. The withdrawal period expires in 14 days from the date of receipt of the goods. The Buyer may exercise the right of withdrawal from the contract to the Seller only in a manner that does not raise doubts about his withdrawal. 

5. The withdrawal period is deemed to have been maintained if the withdrawal notice was sent to the seller within 30 days from the date of receipt of the goods.

6. Upon effective withdrawal from the contract, the seller shall return to the buyer the payments made by the buyer, in connection with the conclusion of the purchase contract, in particular the purchase price, including delivery costs. However, the seller is not obliged to pay the additional costs to the buyer if he has chosen a delivery method other than the cheapest standard delivery method offered. Payments shall be refunded to the Buyer without undue delay and in any case no later than 14 days from the date of receipt of the withdrawal notice. The refund is made in the same way that the buyer used to make the payment to the seller, without charging additional fees.

7. The store will not accept returns sent with payment for shipping on delivery.

8. Returned goods must not show signs of use, must be in the original packaging and contain all tags, otherwise they will be sent back to the customer at their expense.

7. Warranty and claims of ordered goods

1. All goods available in the store are covered by the sellers warranty. The Seller is responsible to the Buyer for the fact that the goods sold are in accordance with the purchase agreement, in particular that they are free from defects. Conformity with the purchase contract means that the goods sold have the qualities and performance properties declared by the Seller, the Seller or Sellers representative or the quality and performance properties for a thing of this kind that is used to meet the legal requirements and the purpose declared by the Seller for the use of the goods; for which the goods are normally used.

2. The basis for settling the claim is the proof of purchase (fiscal document or invoice).

4. Each claimed goods must be accompanied by a claim in email format, indicating the reason for the claim, together with information on when and under what circumstances the defect occurred. It is also necessary to indicate your name, surname, address, order number and information on how to proceed in case of accepting the complaint (exchange, repair, refund).

5. Claimed goods must be clean and hygienic. Otherwise, the store reserves the right to refuse to accept a claim.

6. The complaint will be dealt with within 14 days of receipt of the goods by the store, and the customer will be informed of the outcome of the complaint.

8. Transport

1. Shipping costs for returned goods will be borne by the customer.

2. The Ms. Me store manages orders placed on the territory of Switzerland only. The shipping method is Swiss Post.

4. Prices for transport are indicated on the checkout page when placing the order .

Exceptionally, if Swiss Post shipping costs change, the customer will be informed of this before the goods are shipped.

5. The maximum delivery time is 25 working days for ‘backorder’ orders, starting from the date of registration of the payment in the store’s bank account. 

6. Orders are delivered on business days only.

7. If there is visible damage to the package or the packaging is torn when the package is received, there is a risk that the contents of the package have been altered by a third party. In this case, you should refuse to take delivery, write a damage report in the presence of the deliverer and notify the Ms. Me store’s customer service.

9. Payment

1. Customers shopping on Ms. Me Fashion agree to the issuance of a proof of payment that does not contain a signature.

2. The standard is the issuance of a tax document as proof of purchase. We will also issue a VAT invoice upon request. 

3. Upon delivery of the goods, the customer is obliged to check whether the fiscal document is part of the delivery.

4. The customer can only choose the card/electronic payment systems on the Ms.Me Fashion website for payment.

10. Promotion codes terms and conditions

Ms. Me promotion codes entitle you to an offer on your online order from www.msmeshop.com. Please note, promotion codes can only be used once per transaction and cannot be used in conjunction with any other promotion or offer. Promotion codes are territory specific, remain our property, there is no cash alternative. Promotion codes are only valid on www.msmefashion.com for payments made by residents of Switzerland in CHF.

11. Final Provisions

2. Prices and special discounts cannot be combined in our online store.
